The issue of declassifying the court ruling, which was given permission to conduct operational-search activities that restrict the constitutional rights of citizens, is raised in the course of criminal proceedings after the implementation of operational information through these activities. Attention is drawn to the fact that the legislator has not determined which document should be drawn up to resolve this issue and by whom. Is this part of the powers of the court, which previously issued a decision on permission to conduct operational-search activities with an appropriate degree of secrecy, or can the issue be resolved by the head of the body authorized to carry out operational-search activities? The authors offer their own version of the answer to the question posed.
