The article deals with issues related to the definition of the methodological and epistemological essence of evidence as a kind of knowledge. It is concluded that the process of evidence is a logical mental activity, which includes the analysis of the available evidence in their relationship with each other, the study of the sources and conditions for obtaining evidence, the procedural order of their receipt, storage and research. The practical significance of the procedure for observing the procedural form in the process of evidence and verifying evidence is noted.
