Abstract (English):
Introduction. Cybercrimes in Russia include not only computer virus attacks, remote theft of funds carried out using information technologies, but also Internet bullying – cyberbullying. Despite the fact that in the domestic legislation there are normative legal acts, the provisions of which are quite effectively applied to identify and solve such crimes, the definition of the concept of «cyberbullying» has not yet been legally consolidated. There are still no specialized laws aimed at preventing and countering this negative phenomenon. The article analyzes cyberbullying as a legal concept. The sources of its emergence, classification, characteristic features, objective and subjective meaning of the concept of «cyberbullying», its legal boundaries are considered. Methods. The study conducted by the authors of the article is based on the analysis of scientific sources devoted to cyberbullying. The comparative legal method made it possible to compare the features of prosecution for illegal acts in the information space. Results. Based on the results of studying the etymology of the term, characteristics and types of cyberbullying, the authors formulate a definition of the corresponding legal concept. These are actions committed anonymously or publicly in public information and telecommunications networks, including the Internet, aimed at systematic psychological abuse of the victim through messages containing threats, insults; publication (threat of publication) of information defaming the honor and dignity of the victim, including through illegal seizure of his/her personal data; social boycott; persecution and threat of physical violence; resulting in a depressed psychological state or the emergence of mental disorders in the victim. The need for legal regulation of the fight against cyberbullying in the Russian Federation is due, in particular, to the fact that most often its victims are minors. The development and adoption of a regulatory legal act to counter cyberbullying will help to increase the level of protection of users of information and telecommunications networks from cyber aggression.
