The article presents some results of a study of such a phenomenon as ill-treatment of a minor, in relation to the corpus delicti under Art. 156 of the Criminal Code of the Russian Federation «Failure to fulfill the obligations of raising a minor». Based on the generalization of the theoretical approaches of scientists to the definition of the concept of «cruelty» and the analysis of law enforcement practice, conclusions are formulated regarding the criterion of cruelty in the framework of the qualification of the considered criminal act. Attention is drawn to the repeated commission of an unlawful encroachment as an obligatory sign of a crime.
