The article presents the results of a scientific analysis of the generally accepted theses that embezzlement is committed with direct intent and is recognized as a completed crime at the time of taking possession of someone else's property. The conclusion is substantiated that in fact the embezzlement is committed with indirect intent and ends at the time of the fait accompli of causing property damage covered by the intent of the perpetrator. It is shown that the main reasons for the erroneous solution of these issues are: misunderstanding of the antisocial essence of embezzlement, its consequences; contradictions between the correct understanding of these issues and the erroneous theses of the doctrine of criminal law; incorrect description of embezzlement in criminal law. Based on the results obtained by the authors, it is proposed to amend the doctrine of criminal law and the Criminal Code of the Russian Federation
