Abstract:
The article reveals the role of the witness in Russian criminal proceedings and provides a historical justification for this role. Arguments are given in favor of the opinion that a witness in a criminal trial needs protection. The importance of conciliation mechanisms for ensuring the rights of a witness is revealed. The types of consent accompanying the participation of a witness in criminal proceedings are determined. The author has formulated proposals for correcting the legal regulation of conciliation mechanisms in the context of the participation of a witness in criminal proceedings. Their significance for the criminal procedural law of Russia is substantiated.
